Tracking Devices And HIPPA
I was just informed that my son might not be able to use Angelsense in his school because of the microphone and "listen in" feature possibly violating HIPPA. Has anyone else run across this issue or know of a regulation prohibiting this device? Thank you in advance!
Hi - I work for AngelSense and also use the gps tracker. We encourage parents to provide the school access to the AngelSense application. Also - you can have the device written into your child's IEP as "assistive technology" and the Listen-In can be disabled during school hours and automatically back on once your child is out of school. To aid in the search for the child, in cases of elopement - the Listen-In feature can be temporarily enabled by the authorized school personnel if you've given them access to the AngelSense School Dashboard (which is a different view of the app for school hours) and protects privacy concerns. Also, any overheard conversation in the presence of your child about another child's medical situation should not be taking place in the first place. AngelSense does not record so there is no legal reason for not allowing them to wear it to school. HIPPA is related to medical or health information being kept private. If someone is talking about another kids medical issues in front of my kid - he can repeat it word for word and they are violating the other kids privacy. I don't believe the schools that try to use this as an excuse. They just don't understand the fear of a child that elopes and how AngelSense is actually there to keep the child safe...not listen in on other students or teachers, besides who has time to listen in to their conversations? But...if I didn't trust them and I had reason to believe something bad was happening within hearing distance to my son...you better believe I want to know about it. I also love the idea of cameras in classrooms - what do they have to hide?
Federally no, however, state wise yes....depends on where you live and what your child's IEP specifically states....
I saw this product pop-up on my Facebook feed. I was reading through and someone had a similar problem. A rep from the company said that they can disable that feature during school hours. Someone else mentioned that it could be included on the IEP (not sure if this is true). Good luck! I think it's a great product and will look into it when my little one starts school.
