Does Anyone Know About The IDEA Compliance And Setting Up Date And Time Around The IEP Team Mutual Dates Even If Its During The Summer?
I have rescheduled my sons IEP meeting. THe prinicipal and Vice are gone for the year due to personal issues. The acting Special Education person stepping in for the IEP team who already know is telling me that school employees which are 10 month employees are not required to come in. They must abide by the timeline. Is this his annual IEP? If so a new IEP must be must be put in place by the annual date. Even if it is summer. Most schools have an IEP staff that works over the summer so they can meet these deadlines. Our school adjusts all IEPs to be held before the last day of school so that the people who work with the student will be present. You loose absolutely nothing if the school is unable to hold the IEP on time but the school can get in big trouble if they don't. If this isn't an annual IEP and one that you requested that changes the timeline. They must schedule within 10 days and must hold the meeting within 30 days. If you rescheduled the meeting then it is very possible they met without you to stay within the legal guidelines and then that breaks all timelines. I know this all sounds confusing but it is in your best issue to make sure they hold the meeting so that everything you need will be in place for your child come the beginning of school next year.
I've worked in special education for almost 20 years in the Northeast and I have never been called in for an IEP meeting over the summer. Special Ed administrators sometimes work part of the summer and could meet, but they can not require his regular school team to attend. Good luck!!!

Andrea...above is a link regarding national and individual state resources. It is a handbook. There is a chart towards the end that shows the process. Also, there are resources listed in the appendix.
In any case, certain school employees ARE required to attend an IEP meeting such as a general Ed. teacher and sped teacher so the "acting special education" person doesn't know what she is talking about and the fact that hese classroom employees DO have to attend makes her premise invalid.
