Has Anyone Had To Deal With Truancy Charges From The School And States Atty Despite Their Child Being On The Spectrum And An IEP?

My daughter has been in treatment since the age of 3 and hospitalized 3 times since 2009 when she was 6, she is in a public school but has an IEP yet the school had the states atty file charges of neglect in the form of truancy against us. she is not truant, she is non compliant. she is in an institution now and was also back in dec. i have an atty but she was still assigned a CASA worker (court Appointed SPECIAL Advocate). the school is pushing for the state to make her a ward of the court… read more

Make sure you have it in her IEP that the days she is non-compliant are EXCUSED absences. Have her doctor write a letter to the school, that helps. If anyone had touched my daughter, I would have an attorney write them a letter (at a minimum). You can also tell them that on the days she is non-compliant you want a home teacher. That usually shuts them up, too. I have been there, done that.

one more thing...make sure she has what they call a BMP or a behavioral management plan. It dictates exactly who does what and how they do it when her behavior is non-compliant. Yours might read, for instance: Sally will be directed to comply and if she reacts violently or flees the area, so and so will do thus and such while person X contacts Mother or person Y. This is a great way to protect both your child and the school.

if you can stay home this is nuts and the school is going too far they can not make you leave your child switch schools or try private

Give your daughter's CASA as much info as possible on autism and sensory issues, so that they will be well informed. I think in any case a CASA can't hurt, even though they don't represent you, but your daughter. How can the school even be involved in who her guardian is? And how are they bringing in truancy if she is missing school? Is it possible for you to try a different school? Make sure if you need her to be able to miss school that you have it in her IEP. I don't really have any other suggestions but my heart goes out to you.
